PURCHASE INFORMATION

ORDERING

  1. Select the products you want to buy from the e-store and press the "Add to basket" button.
  2. By opening the shopping cart, you have the option to correct the quantity of products and delete products from the shopping cart. If available, you can also enter a discount code.
  3. When you have entered all the products in the shopping cart, press the "Checkout" button.
  4. All fields marked with an asterisk (*) must be filled in the order.
  5. Select the appropriate shipping method on the checkout page. It is also important to enter the delivery address.
  6. Then select the appropriate payment method, agree to the terms of the e-store and press the "Submit order" button.

PRICES AND PAYMENT

All our prices (in the e-shop) are in euros.

After placing the order, it is possible to pay for the order using either a bank link or a bank transfer. The invoice will be sent to the e-mail after the order has been completed.

DELIVERY TIME AND TRANSPORT

We will deliver the goods to your desired address across Estonia no later than 3 working days after receipt of the advance payment invoice. The exact time of delivery of the goods is agreed in advance by phone or email. The goods are delivered on working days between 10:17 and XNUMX:XNUMX.

RETURN OF GOODS

Goods are returned in accordance with the laws in force in the Republic of Estonia. Detailed information can be found in the General and purchase conditions.

GENERAL AND PURCHASE TERMS AGREEMENT AND LIABILITY

These Terms and Conditions are a binding contract between you as the customer of the Hortulus OÜ website and the products offered on it, and Hortulus OÜ, Harju maakond, Tallinn, Kesklinna district, Pärnu maantee 368, 11612, hereinafter referred to as Hortulus OÜ, for the delivery of goods through this website. By using this website, you agree to these Terms and Conditions, which also apply to all orders placed through or in connection with this website.

The offers made by Hortulus OÜ and the descriptions of products and services cannot be treated as a contract and are not subject to these Terms and Conditions. Product images have an illustrative meaning.

DELIVERY OF PRODUCTS IN ESTONIA

All products ordered by you will be sent to the destination you have specified when placing the order, using the delivery method you have chosen.

The price calculation of the delivery is done automatically and its final price is shown separately on the invoice.

The goods will be delivered by the seller to the specified address across Estonia no later than 3 working days after receipt of the advance payment invoice.

Hortulus OÜ is not responsible for the delivery of the goods if the address you specified when placing the order is incorrect.

Hortulus OÜ may, at its sole discretion, refuse your orders without any explanation.

PRICE INFORMATION

Prices in the online store include VAT.

Postage is indicated separately.

The currency of the e-shop is euro.

It is possible to pay for goods sold in the e-shop by bank transfer on the basis of an invoice.

The online store is not responsible for any other taxes or customs duties that may be applied to you and for which you remain fully responsible.

The online store reserves the right to change the price list at its discretion and without notice in all cases, except for those cases where the order has been confirmed but not yet fulfilled.

The purchase price is paid in advance as a bank link or bank transfer payment.

Hortulus OÜ is the responsible processor of personal data.

When making purchases from the e-store, it is also possible to use coupon codes, which can be entered at checkout. Coupon codes are distributed in online store advertisements and marketing channels.

RIGHT OF RETURN

  1. The customer has the right to withdraw from the contract (relinquish the products) within 14 calendar days of receiving the products, except for the cases specified in clauses 2 and 3.
  2. Pursuant to Clause 53(2)(9) of the Law of Obligations Act (hereinafter: VÕS), the 14-day right of withdrawal from the contract does not apply to the purchase of food, beverages and/or other products for daily consumption, which are handed over during the entrepreneur's frequent and regular visits to the consumer's residence, place of residence or workplace .
  3. Due to VÚS § 53 (4), the 14-day right of withdrawal from the contract does not apply, among other things:- to a product that spoils or ages quickly;- to the delivery of a product in a sealed package that is not suitable for return due to health protection or hygiene reasons and if it has been opened after delivery.- for which specific or recommended storage conditions are prescribed.
  4. To withdraw from the contract, the Customer submits a Return Application. The Customer can submit a return application by sending it to the Seller's e-mail address: hortulus@hortulus.ee or by sending an e-mail from the Seller's website. After the application has been reviewed by the Seller, the customer will be notified of the return address.
  5. Returned products must not be spoiled, damaged or used and must be in their original product packaging. In order to make sure of the nature, properties and functioning of the thing, the Customer must handle the product only as he would normally be allowed to do in a store. The product packaging must be opened carefully without damaging it. Otherwise, the Seller has the right to demand compensation from the Customer for the decrease in the value of the product.
  6. The products to be returned must be sent to the Seller immediately, but no later than within 14 days of submitting the withdrawal request. The costs related to the return of the product shall be borne by the Customer.
  7. If the Customer has withdrawn from the contract, returned the products to the Seller, and the returned products are in order (including taking into account the points 2 and 3), the Seller will return the cost of the order to the Customer along with the delivery fee within 14 days of submitting the withdrawal statement. Refunds are made to the Customer to the same current account from which the money for the order was received.
  8. If, after returning the goods, it becomes apparent that the return does not meet the conditions stated in the User Agreement, the money will not be returned.

If the goods are broken or the goods have significant damage(s) that were not immediately detectable on external inspection and that did not occur when the package was opened, or if the goods are incorrect, please inform Hortulus OÜ immediately at hortulus@hortulus.ee.

CLAIMS PROCEDURE

The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the buyer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item.

The buyer has the right to contact the online store within two months at the latest by sending an e-mail to hortulus@hortulus.ee.

The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.

The online store shall respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.

SECURITY

The online store uses all reasonable options to avoid any violations of the law regarding security, including credit card information provided by you. The online store also uses all reasonable options to ensure that each supplier/subcontractor or partner of the online store also ensures the confidentiality of the data at its disposal. You are solely responsible for the security and use of your usernames and passwords required for access to use the Service or any part thereof. Any use of your password will be interpreted as entered by you, and you are responsible for all activities performed under that password.

AVAILABILITY OF GOODS

Hortulus OÜ reserves the right to stop, change or change the list of goods for sale in the online environment without notice and without any reason.

OTHER CONDITIONS

Nothing in these Terms shall confer any benefit or right on any third party to enforce the terms of this Agreement. These Terms constitute the entire agreement between you and the online store and supersede any oral or written agreements or other statements. The Online Store reserves the right, at its sole discretion, to add or change these Terms and Conditions at any time without notice (this does not apply to confirmed orders that have not yet been fulfilled). These Terms are subject to the laws of the Republic of Estonia and are under the jurisdiction of the judicial system of the Republic of Estonia. You must ensure that you have read and fully understood these Terms before placing an order.
